General duties |
- The employer is liable for the state of occupational safety and health in the company
- The employer is obliged to protect the health and lives of the workers by providing safe and healthy working conditions, with the appropriate use of science and technology, in particular:
- To organise work in a manner that assures safe and healthy working conditions taking into account:
- *the requirements on the types of work that require psycho-physical fitness (as defined in the regulation of the Minister of Labour and Social Policy of 28 May 1996 on the types of work requiring particular psycho-physical fitness, Journal of Laws 1996 r. no. 62, item 287), such as e.g.:
- operation of hoists and hydraulic platforms
- operation of tower and wheeled cranes
- operation of mobile heavy construction equipment and road
construction machinery
- operation of mechanical equipment related to demolition activities
- operation of pressurised equipment requiring full technical supervision
- work with flammable materials, toxic substances and biologically
contaminated materials
- work on viaducts and bridges - *the requirements on the type of work that should be conducted by at least two people (as specified in the regulation of the Minister of Labour and Social Policy of 28 May 1996 on the types of work that should be fulfilled by at least two people, Journal of Laws of 1996, no. 62, item 288), such as:
- work performed inside tanks, boilers, silos and technological
equipment, including work in open reservoirs, which do not allow for
direct visual contact with at least one employee
- work related to the assembly and disassembly of wells, water
pumping stations at depths of greater than 2 m
- work related to the maintenance, assembly and repair of lifts,
overhead travelling cranes, tower and wheeled cranes, warehouse
stacking equipment and escalators
- welding work, gas or electrical cutting and other work requiring the
use of an open flame in closed premises or in premises that are
subject to the threat of fire or explosion
- work undertaken at a height of greater than 2 m in cases where the
use of personal protective equipment that protects against falling from
altitude is required
- work in excavations of depth in excess of 2 m - *the requirements regarding work at height (any work undertaken at more than 1 m from the floor is work at height)
- *the requirements on the types of work that require psycho-physical fitness (as defined in the regulation of the Minister of Labour and Social Policy of 28 May 1996 on the types of work requiring particular psycho-physical fitness, Journal of Laws 1996 r. no. 62, item 287), such as e.g.:
- To ensure the adherence to the rules and regulations on occupational safety and health, to issue instructions to remove infringements in this area and to inspect the adherence to the recommendations
- To ensure the adherence to orders, motions, decisions and instructions issued by the authorities that supervise working conditions
- To be familiar with the regulations on work protection, including the rules and regulations on occupational safety and health to the extent required to fulfil his obligations
- To familiarise the workers with their job specifications, the method of fulfilling their work at their specific work posts, including the provision of training on occupational safety and health before allowing them to work and to ensure that training is held periodically in this respect
- To notify the competent labour inspector and state health inspector in writing 30 days from commencing activities of the place, type and scope of activities conducted
- To designate a coordinator to supervise safety and health, in the event that workers employed by various employers are working simultaneously in the same place
